Terms of use

Kept keeps track of your cover. It does not provide that cover — and the difference matters enough to be the third section on this page.

Who these terms are with

Kept is made and operated by Akintade Oluwaseun, trading as Kept, an individual developer based in the United Kingdom, referred to below as "I" or "me". "You" means the person using the app. Contact: hello@getkept.xyz.

Kept is downloaded through the App Store, so Apple's own terms apply to the download and to any purchase you make. These terms cover the app itself.

Accepting these terms

Using Kept means you accept these terms. If you do not, the honest remedy is not to use the app — and if you have paid for a subscription you cannot use, contact me and I will help you get it refunded through Apple.

What Kept is, and what it is not

Kept is a record-keeping tool. It reads receipts, stores what it finds, and reminds you before a return window or warranty period appears to end.

Kept does not provide, extend, underwrite, administer, or guarantee any warranty, guarantee, insurance policy, or return right. Whatever cover you have comes from the retailer or manufacturer you bought from, under their terms. Kept only keeps a record of it.

Coverage dates in Kept may be wrong. They are read from receipts and, where a receipt does not state the terms, estimated. Before you rely on a date — to delay a return, to decide a claim is still open, or to let one lapse — confirm it with the retailer or manufacturer. Kept marks estimated values as estimated for exactly this reason.

Two further limits worth stating plainly:

  • Reminders depend on iOS. Notifications are scheduled on your device and can be delayed or suppressed by notification settings, Focus modes, low power mode, or a device that is off. Treat a Kept reminder as a helpful prompt, not as your only safeguard against a deadline.
  • A claim pack is a document, not an entitlement. Kept assembles your evidence into a PDF. Whether a retailer or manufacturer accepts a claim is entirely their decision.

Kept is not legal advice, and nothing it produces is a substitute for the terms you actually agreed to at the point of purchase.

Your licence to use Kept

You get a personal, non-exclusive, non-transferable licence to use Kept on devices you own or control, for your own purposes, for as long as you comply with these terms. That licence does not let you copy, resell, rent, reverse engineer, or attempt to extract the source of the app, except where the law says you may regardless of what a contract states.

Kept Pro

Kept is free to use with a limited number of stored records (currently five). Kept Pro removes that limit and unlocks additional features, including iCloud sync.

  • Billing runs through Apple. Payment is charged to your Apple Account at confirmation of purchase. I never see your payment details.
  • It renews automatically. A subscription renews unless you turn off auto-renewal at least 24 hours before the current period ends. Apple charges for the renewal within the 24 hours before the period ends.
  • You cancel through Apple. Manage or cancel in your Apple Account settings. Uninstalling the app does not cancel a subscription.
  • Refunds are Apple's to give. Apple handles App Store purchases and refunds, so refund requests go to Apple. Tell me if you hit a wall and I will help where I can.
  • Prices can change. If a price changes, Apple will notify you and, where required, ask you to confirm before the next renewal.

None of this affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015.

Your records stay yours

You own your receipts, photographs, and records. I claim no ownership of them and acquire no right to use them for anything beyond running the app for you. The only processing that happens is described in the Privacy Policy: structuring receipt text, signing Wallet passes, and handling your subscription.

You are responsible for keeping your own copies of anything you would be upset to lose. Kept stores records on your device, and a lost, wiped, or broken device takes them with it unless iCloud sync is on.

Acceptable use

Do not use Kept to:

  • break the law, or store material you have no right to hold;
  • forge, alter, or fabricate a receipt or proof of purchase, or assemble a claim pack intended to mislead a retailer, manufacturer, or insurer;
  • interfere with the app's services, evade rate limits, or use the extraction or signing endpoints outside the app;
  • attempt to gain access to systems or data that are not yours.

Availability

Kept is offered as it is. Its core features work offline on your device, but receipt extraction and Wallet pass signing depend on services that may be interrupted, changed, or withdrawn — including third-party services outside my control. I may add, alter, or remove features, and I may stop offering the app entirely. Where a change would remove something you have paid for, I will give reasonable notice and, where appropriate, help you obtain a refund through Apple.

Intellectual property

The Kept name, logo, interface, artwork, and the software itself belong to me and are protected by copyright and trade mark law. These terms give you a licence to use the app, and nothing else.

Liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that: I am not liable for a lost claim, a missed return window, an expired warranty, a rejected claim pack, an inaccurate extracted date, or a notification that did not arrive. Kept is a record of your cover, and the responsibility for acting on that cover in time remains yours.

I am not liable for losses that were not reasonably foreseeable when you started using the app, or for business losses — Kept is supplied for personal use, and if you use it for a business, I have no liability for lost profit, lost business, or lost opportunity. Where liability can be limited, it is limited to the amount you paid for Kept in the twelve months before the claim arose.

Ending this agreement

You can end it at any time by cancelling any subscription through Apple and deleting the app. I may end it if you materially breach these terms, particularly the acceptable use section. Ending the agreement does not by itself delete anything held on your device — use Settings → Data → Delete all data for that.

Changes to these terms

These terms may change as the app changes. The date at the top of this page records the last revision, and material changes will be surfaced in the app rather than left here for you to find. If you do not accept a change, stop using Kept and cancel any subscription.

Governing law

These terms are governed by the law of England and Wales. If you are a consumer, you can bring proceedings in the courts of England and Wales or in the courts of the country where you live, and you keep the benefit of any mandatory consumer protections in that country.
